Litigation

Our firm's litigation section serves our clientele in two distinct ways. First, our litigators will very often work as a part of the team with the lawyer serving as a client's principal counsel, helping to structure an approach to a situation that will avoid or minimize exposure to costly court actions. Second, should a matter require recourse to the courts, we are able to handle every potential representation in State or Federal court.

Our litigators also function as substantive experts in particular areas of the law, including:

Corporate and Labor Law. We have a broad base of experience in all aspects of litigation relating to contracts, real estate matters, securities and fraud matters, environmental law, employment rights and mortgage foreclosures, as well as commercial and collection matters.

Personal Injury and Insurance Law. All of our litigators are experienced in the representation of personal injury claimants and defendants. We also offer services in the very specialized area of insurance law. Most of our work in insurance law consists of advising clients as to the coverage afforded by their various policies and the bringing or defending of actions for and against insurance carriers on these coverage questions.

Medical Malpractice Defense. Our litigation partners maintain an extensive practice in the defense of medical malpractice cases. In addition to defending cases involving our hospital clients, our attorneys are often called on to advise physician clients who have themselves been subjected to malpractice claims and are in need of advice on the applicability of their insurance and an evaluation of the particular matter.

Defamation, Right to Privacy and Freedom of Information Act Law. The firm has substantial experience in these areas of the law and, among other clientele, represents a major news service in our area.

Construction Law. Several of our litigation partners are well-versed in resolving construction arbitration and litigation matters, which can and often do involve foreclosure of mechanic's liens.

Real Estate Law. Our firm also has special expertise in the area of real estate litigation. This includes actions involving boundary disputes, access rights, construction liens, oil, gas, and mineral interests, quiet title actions, title disputes, title insurance claims, partition actions, easement rights, the enforcement of restruction covenants, and mortgage forclosures.

Our litigators are William M. Newman, Alvin D. Treado, Thomas H. Thornhill, Charyn K. Hain, and David P. Covell, supported by Rebecca McCroskey, our senior legal assistant.
